We believe that a seminar in the area of arbitration in China could potentially be an interesting topic for foreign companies in China
China has attracted substantial business from European companies, and this exposure has produced a significant increase in the number and complexity of arbitration cases. The China International Economic and Trade Arbitration Commission (CIETAC) has become one the world’s busiest arbitration commissions. Knowing how to effectively deal with arbitration--such as when or when not to arbitrate and how to avoid its pitfalls--is essential when doing business in China.

The content of the presentation will be as follows:

I. Why arbitration ?
II. Which arbitration clause/arbitration institute for which contract ?
III. Avoiding pitfalls when drafting an arbitration clause – model clauses
IV. What may be useful to add to a CIETAC model clause?
V. No valid arbitration clause and now ?
VI. Enforcement of arbitration awards


Speaker

Dr. Björn Etgen, partner and head at BEITEN BURKHARDT China Practice, has extensive experience in foreign direct investment matters, M&A transactions and dispute resolution in the PRC.

He has represented European companies in various arbitration cases before CIETAC and has been involved in advising on matters related to ICC, International Centre for the Settlement of Investment Disputes (ICSID) and other European arbitration cases. In addition he has acted as arbitrator on various CIETAC cases.

Dr. Björn Etgen is also author of the chapters on China and Hong Kong in the publication “Arbitration in Asia” and has published various articles related to arbitration, enforcement of arbitral awards and related topics.
